Global email marketing has never been more complex from a compliance perspective. With data privacy laws in over 140 countries, a single consent form and privacy policy covering worldwide subscribers is insufficient. Understanding the global landscape is essential for any program with international subscribers.

GDPR remains the gold standard. Its requirements for explicit opt-in consent, clear privacy notices, data subject rights, 72-hour breach notification, and extraterritorial scope have influenced laws worldwide. Penalties reach 4% of global annual revenue for non-compliance.

Canada's CASL and PIPEDA emphasize implied consent alongside express consent. Under CASL, you can send to recipients with an existing business relationship without explicit opt-in for up to two years. CASL's private right of action allows individuals to sue violators.

Brazil's LGPD is closely modeled on GDPR but includes distinct provisions. It applies to any organization processing data of individuals in Brazil. Its legal bases are similar but require more detailed legitimate interest assessments. Brazilian enforcement has been active since 2023.

The practical recommendation is to segment subscribers by jurisdiction and apply the most protective standard, typically GDPR, to all subscribers unless jurisdiction-specific processes are in place. Maintain jurisdiction-specific privacy policies and consent records for compliance.
